RETURNED CHECKS POLICY FOR HAULING, GENERAL SITE SERVICES & DISPOSAL AGREEMENT

If a  Customer issues, delivers and/or tenders a bad check to Company, Company is entitled to collect a bad check fee. A check is automatically considered bad if it is returned by the Company’s bank within 30 days of receipt by the Company. The bad check fee shall be the greater amount of the actual damages caused by the bad check or $20, whichever is higher. Company may also be entitled additional damages as described below and as permitted by law.  NOTICE SHALL BE CONSIDERED VALID AND GIVEN WHEN (a) CUSTOMER’S BANK NOTIFIES CUSTOMER THE CHECK WAS BAD (NOT SUFFICIENT FUNDS) OR (b) COMPANY NOTIFIES CUSTOMER (IN ACCORDANCE WITH THE NOTICES PROVISION OF THE  WASTE HAULING, GENERAL SITE SERVICES & DISPOSAL AGREEMENT, WHICHEVER IS EARLIER.  If Customer does not render payment within 15 days of such notice, Customer acknowledges that it shall be liable to Company or any assignee for collection for an amount equal to three (3) times the face amount of the check but not less than one hundred dollars ($100).
